1. Conclusion of contract
Reservations can be made while using the booking form at mysticcage.com or via info@mysticcage.com. A reservation is only valid, if this is confirmed by Mystic Cage Ltd (hereinafter called “provider” via email. By making a reservation the costumer (customer includes the hole team) confirms our terms and conditions.
2. Services
The services of the provider result from the service description of the website mysticcage.com. When the customer has special requests or there are collateral agreements, are there only part of the contract, if they have been confirmed unconditionally and in written form from the provider. The provider’s services begin with the arrival of the customer at the location of the provider. The customer himself is responsible for the journey and the timely appear. The dates and times must be strictly adhered to. The play areas are specially prepared for the customer. If the customer arrives late, he will no longer be entitled to the full playing time. There is no compensation.
These terms and conditions apply between the provider and the customer and conclusively regulate their contractual relationships. The provider reserves the right to make changes to these terms and conditions at any time. Such changes will be published (for example on the website mysticcage.com) or communicates (for example by email) in an appropriate manner. The terms and conditions valid at the time of the reservation apply to game reservations.
3. Prices and terms of payment
The prices are noted on the website of the provider in the booking process and in the FAQ’s. The prices vary depending on the size of the group. The prices are in Swiss Francs. When booking online, the reservation amount must be paid in advance. Upon special request and written confirmation, the provider can also accept full payment on site. In no case will the prepayment be refunded. If the customer cancels the appointment, the payment made is lost.
4. Number of participants and minimum age
The maximum number of players per game is 6 people. Larger groups are not possible. The minimum age is 10 years. Young people between 10 and 15 years only when accompanied by an adult. The provider is not suitable for wheelchair users and people with claustrophobia and similar anxiety disorders.
5. Terms of Use
Participation is at your own risk. Insurance is the responsibility of the customer or the customer’s legal representative. In the event of damage caused by the customer to the game rooms or their furnishings, the customer is fully liable for this. Photography and filming of any kind is prohibited in the provider’s rooms. The puzzles and their solutions are to be kept confidential. In addition, no puzzles from the provider may be copied or otherwise set up. This requires the consent of the provider.
6. Cancellation of implementation and changes to the program
The provider reserves the right to make minor changes to the course of the game. These changes have no influence on the validity of the subject matter of the contract. It can happen, that the provider has to cancel a booking or spontaneously cancel a game. In such a case, the customer will be informed immediately and an equivalent replacement offer will be made to him. If the customer cannot and does not want to accept the offer, there is no entitlement to a refund of the amount paid. Claims for expenses or losses are excluded in any case.
The provider, represented by the game master, can refuse customers entry without stating any further reasons. If customers are under the influence of drugs or if they are particularly inattentive during the introduction, the game master can also refuse them entry. In this case, refunds are not possible. If customers use force or destroy facilities or puzzles of the provider, the game master can and will stop the game and expel the customers. In this case there is no right to a refund. If the game master’s instructions are not followed, he will issue a warning. If further instructions from the game leader are not followed, the game will end prematurely. In this case there is no right to a refund.
7. Force majeure
If the event has to be cancelled due to force majeure, there is no entitlement to compensation or replacement. Force majeure are incidents which the provider cannot and could not foresee or avert. These include: Terrorism, Political Unrest, Natural Disasters, Lightening strikes, storms and winds, fire and water damage or similar incidents.
8. Liability
Insurance is the responsibility of the customer. The provider has a public liability insurance. Furthermore, the provider ensures that the agreed services are provided with care and appropriate knowledge. The provider assumes no liability for direct or indirect injuries of any kind, losses, deaths, dislike or something like that. The provider also assumes no liability for services to third parties.
9. Data protection
The provider monitors the play areas with real-time cameras. The customer will be informed in advance. All recordings are live and are neither recorded nor saved. This measure only serves to monitor the course of the game and progress and, if necessary, to give the customer hints through a microphone. The game master monitors the live images on the monitor and gives hints.
10. Applicable Law and Jurisdiction
These terms and conditions are subject to Swiss law. Unless mandatory statutory provisions apply, the court at the provider's registered office is responsible. The provider is free to bring a lawsuit at the seat of the defendant. The United Nations Convention on Contracts for the International Sale of Products (SR 0.221.221.1) is explicitly excluded.
